Privacy Policy

(Effective October 1, 2019)

Gamma Communications, Inc.’s use of information that it collects from individuals is described in this privacy policy (“Policy”).   Our Policy applies to our ReceiptRewards mobile fulfillment platform (“MFP”).   We make available various promotional offers on behalf of our clients and other third parties  (“Promotional Offers”) through ReceiptRewards.  Although in our Policy we refer to these as “our Promotional Offers”, they usually involve one or more other companies that we are working with.  As we describe in our Policy, some of the information we collect is shared with these companies and with third parties whose products or services may be used in the Promotional Offers or who are otherwise doing work associated with the Promotional Offers. You can learn more about our business and the types of companies that we work with at http://www.gammacommunications.com/.

 

Information We Collect

We collect information from you when you provide it to us and/or when you use the MFP.  This includes the information you provide in the course of participating in a Promotional Offer, uploading a receipt for a purchase you have made,  or otherwise contacting us or requesting information from us.  As a result of any of these, we may obtain your name, email address, phone number,  and information related to you including your geographic location, the retailer where you made the purchase required to participate in the Promotional Offer, the time and date of the purchase, and other products shown on the purchase receipt you submitted.  

By participating in any of our Promotional Offers, by communicating with us or by using the MFP, you agree to our collecting information as we’ve described it in this Policy.  

Our Promotional Offers are open to legal residents of the United States, our MFP is hosted on servers in the United States, and the information we collect is stored in the United States.

 

How We Use The Information We Collect

We use the information that you provide to us to determine your eligibility for a Promotional Offer, and if you meet the requirements, to fulfill the Promotional Offer you have participated in.  If you contact us with questions or comments, we will use your information to respond to your inquiry.  

For billing, record keeping, compliance, auditing, and fraud detection purposes, we may retain and use your information after we have responded to your request and/or after the end of a Promotional Offer you may have participated in.

Some of the information may also be used by us and/or our clients in developing future promotions and in other ways as described below.

 

Third Party Access To Your Information

We do not share or sell your information that could be used to personally identify you – your name, email address, or phone number.

We may aggregate the information we collect from any receipts you submit, including retailer name and geographic location, the time and date of the purchase, and other products shown on the receipt with the same information from other participants in a Promotional Offer in a way that does not include your name, email, phone number or any other information that would allow you to be individually identifiable (“Anonymous Aggregated Data”) and share or sell that data as described below.  

As part of reporting on the results of Promotional Offers, we provide the Anonymous Aggregated Data to our clients and other third parties who have been involved in planning, conducting, and auditing the results of Promotional Offers, and with the companies and their promotional and advertising agencies that offer promotional consideration (e.g., prizes, rebates, coupons) for the Promotional Offers. Our clients and other third parties working on their behalf or with whom we are doing or may do business, may use the Anonymous Aggregated Data in developing future advertising, marketing and promotional campaigns, in product development planning, to more effectively market their products or services to consumers, and to better understand consumer buying patterns and purchasing decisions.

We use third parties to host and administer our MFP and in the course of the work they do for us, or to prevent fraud or misuse of our MFP in the Promotional Offers, these third parties may access your information.

If a third party were to purchase us or merge our company with theirs, or in the course of negotiating a purchase or merger of our business, we may need to disclose your personal information and the Anonymous Aggregated Data to the purchaser or prospective purchaser and to transfer your information and the data to the purchaser if such a purchase or merger is concluded.  

If we are required by law, legal process or in response to requests from law enforcement, or if in our sole determination it is necessary for the protection of our or our client’s interests, we reserve the right to use and disclose your personal information. 

Except as described in this Policy, we do not sell or otherwise share your personal information with third parties.

 

Use Of Cookies 

“Cookies” refer to software code that is placed on your device in the course of your accessing and using our MFP (and websites generally).  We, or third parties that provide us with analytical services, use cookies and other technologies to track your use and navigation of our website and in some cases the particular pages and products or services that you view.  We use this information to provide you with more relevant content and also to improve the usability and content of our MFP.

You can block cookies from being placed on your device through the settings tab of your browser.  Blocking cookies using your browser setting may not, however, prevent third-party ad networks from being able to track your navigation and viewing.  It may also affect your ability to use or navigate certain features on the MFP.

 

Do Not Track

Our MFP does not track your browsing activity, so whether or not you have turned off the “do not track” setting of your browser, we do not collect any information related to your browsing activity.   

 

Storing Your Personal Information

We store the information we collect as long as reasonably necessary for the purposes described in this Policy, unless we are legally required to keep it for a longer period by applicable U.S. law. Anonymous Aggregated Data may be retained and used indefinitely by us and/or any third parties to whom it has been provided.

Keeping Your Information Safe 

We use one or more third parties to administer and host our MFP and that administrator(s) is obligated to use industry standard protocols and software to reduce the risk of loss, unauthorized access, disclosure, or misuse of your information. However, no data is 100% secure, and we are not able to provide any assurances that the information that we collect and store will be secure or that it will not be subject to loss, unauthorized access, use or disclosure. 

Use by Children

Because our Promotional Offers involve a variety of products, the minimum age for participation in a Promotional Offer is set specifically for each promotion. Generally, our promotions  are intended for people 18 years or older who are legal U.S. residents.  Our MFP is not directed toward children under the age of 13.  If you are the parent or guardian of a child under the age of 13 and believe we may have collected information about your child without first getting your permission, please contact us at the email or mailing address below. In such a case, you may review and request deletion of your child’s information as well as prohibit any use of that data.

California users under the age of 18 may request the removal of any publicly available content or information they have uploaded using the MFP by sending us an email or contacting us by mail. Please note that it may not be possible to remove all such content when it is stored and controlled by third party providers.

Updates and Revisions to this Policy

We may change or update this Policy from time to time and will indicate in the Policy what has materially changed when and if we do that. We encourage you to check for updates.  

Notice To California Residents

California law gives California residents the right to request certain information relating to what we have collected (and are storing) from them. If you are a California resident and would like to request the information as described in California Civil Code Section 1798.83, please send us a written request (see How To Contact Us, below).
